Terms of Service

By creating a Mentawe account or using the Mentawe service (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

The Service is operated by Mentawe.com, a trading name operating in the United Kingdom. Mentawe is not currently incorporated as a registered company. These terms will be updated upon incorporation. The operator is referred to as "Mentawe", "we", "us", or "our" throughout.

Mentawe is an AI-powered workplace coaching tool that helps professionals understand workplace dynamics and plan their next steps. The Service uses large language model (AI) technology provided by OpenAI to generate responses based on the information you provide.

The Service is intended for professional and informational purposes only. Nothing produced by Mentawe constitutes professional advice — legal, financial, HR, psychological, or otherwise. You are solely responsible for any decisions you make based on Mentawe's responses.

We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

You must be at least 18 years old to use Mentawe. By using the Service, you confirm that you meet this requirement.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately via our contact form if you suspect unauthorised access.

You may not create an account on behalf of another person without their explicit consent.

Mentawe is offered on a subscription basis. New accounts receive a 7-day free trial with no payment details required at sign-up. Trial access is limited to 5 people in your influence graph, 20 AI interactions, and 60 minutes of recorded meeting audio. After the trial, continued access requires a paid subscription at the rate displayed at the time of purchase (currently £9.99/month).

Payments are processed by Stripe. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel.

You may cancel your subscription at any time from the Billing page within the app. Cancellation takes effect at the end of the current billing period; no partial refunds are given for unused time, except as required by law.

No-refund policy: Because Mentawe provides a free trial that gives full access to the core features before any payment is required, all subscription payments are non-refundable once made. By subscribing you acknowledge that you have had the opportunity to evaluate the service during the trial period and are satisfied it meets your needs. This does not affect any statutory rights you may have under applicable law.

Statutory cooling-off right: If you are a consumer in the UK, you have a 14-day right to cancel a new subscription under the Consumer Contracts Regulations 2013. However, by subscribing you may expressly request that we begin providing the service immediately; if you do so and the service has commenced, your right to a refund under the cooling-off period may be reduced pro-rata or lost entirely in accordance with Regulation 36 of those Regulations. To exercise any remaining cancellation right, contact us via our contact form within 14 days of subscribing.

We reserve the right to change our pricing with at least 30 days' notice. Continued use after the notice period constitutes acceptance of the new price.

Mentawe operates a referral programme. When you invite another person using your unique referral link and that person signs up and becomes a paying subscriber, both you and the person you invited receive a 25% discount: the invited person receives 25% off their first paid month, and you receive a credit equivalent to 25% of one month's subscription. Each successful referral earns a further such credit, which stack and are applied to your future invoices.

Referral rewards have no cash value, are non-transferable, and cannot be exchanged for money. A reward is only earned when the invited person completes a paid subscription; it is not earned on account creation alone, and is withdrawn if the corresponding payment is refunded, reversed, or charged back.

You may not refer yourself, create multiple or fake accounts, or otherwise abuse the programme. We may withhold or reclaim rewards, and suspend accounts, where we reasonably believe the programme has been abused. We may change, suspend, or end the referral programme, or vary the discount amount, at any time with reasonable notice. Rewards already validly earned will be honoured.

You agree not to:

• Use the Service to harass, intimidate, or defame colleagues or any other person.
• Input content that is unlawful, threatening, abusive, or that infringes any third party's rights.
• Attempt to reverse-engineer, scrape, or extract data from the Service in any automated way.
• Use the Service to make decisions that discriminate unlawfully on the basis of protected characteristics.
• Share your account credentials with others.
• Record a meeting using the recording feature without first obtaining the informed consent of all participants in the recording, in compliance with applicable law (including, in the UK, the Investigatory Powers Act 2016 and the Telecommunications (Lawful Business Practice) (Interception of Communications) Regulations 2000).

We reserve the right to suspend or terminate accounts that violate these terms without notice.

Mentawe's coaching responses are generated by an AI language model. AI can make mistakes, misinterpret context, or produce outputs that are not accurate or appropriate. You should use Mentawe's responses as one perspective to consider, not as definitive guidance.

We make no warranty that AI-generated content is accurate, complete, or suitable for your specific circumstances. We are not liable for any loss or damage arising from decisions you make based on AI responses.

Workplace situations you describe are processed by OpenAI via their API. By using the coaching features, you consent to your descriptions being sent to OpenAI for processing as described in our Privacy Policy.

Mentawe provides features that allow you to record meeting audio, upload meeting transcripts, and connect to your Google Calendar. The following terms apply specifically to these features.

Recording consent is your responsibility. By using the recording feature, you represent and warrant that: (a) you have obtained the explicit, informed consent of every participant in the meeting before recording begins; (b) you have complied with all applicable laws governing the interception and recording of communications in your jurisdiction; and (c) you will not use recordings to collect information about individuals without their knowledge. Mentawe accepts no liability whatsoever for any claim, penalty, or damage arising from your failure to obtain proper consent.

Sensitive information in recordings. You acknowledge that meeting recordings and transcripts may contain sensitive, confidential, or special-category personal data relating to third parties (including colleagues, clients, or other individuals). You are solely responsible for: (a) ensuring you are legally entitled to process and submit such data to the Service; (b) complying with all data protection obligations owed to those individuals; and (c) any consequences arising from the disclosure of sensitive information via the Service. We process such content solely to provide the Service and in accordance with our Privacy Policy. We expressly disclaim all liability for the content of recordings or transcripts you submit.

Audio processing. When you record a meeting, the audio is sent to OpenAI's Whisper API for transcription. The resulting text transcript is then sent to OpenAI's chat model for analysis. Audio files are not permanently stored by Mentawe; only the text transcript and the AI-generated analysis are retained. OpenAI does not use data submitted via the API to train its models by default. See OpenAI's privacy policy for full details.

Google Calendar integration. If you connect your Google Calendar, Mentawe requests read-only access to your primary calendar to display upcoming events and pre-populate meeting preparation forms. We do not store your calendar events on our servers; data is fetched directly from Google in your browser session. You may revoke this access at any time from your Google account security settings.

Third-party data in meetings. When you input or upload information about colleagues, clients, or other individuals, you confirm that you are entitled to share that information for the purpose of using the Service. You are the data controller for third-party personal data you introduce into Mentawe. Mentawe acts as a data processor in respect of such data.

Shared meeting context across multiple users. Mentawe is designed to work better when more than one participant in the same meeting or working relationship uses it. Where two or more users are connected to, or provide context about, the same meeting or the same individuals, you agree that Mentawe may combine and cross-reference that context — including objectives, stakeholder notes, and meeting information each of you provides — to generate guidance that seeks a fair and constructive outcome for all participants, rather than serving any single user's interest in isolation. We will not disclose one user's private notes verbatim to another; we use them only as input to the guidance the Service produces. By using the Service, and in particular by inviting others to join, you consent to your meeting context being used in this combined way, and you confirm you have any consents needed from other participants. If you do not wish your context to be combined in this manner, you should not invite others to the same meetings or use the shared-context features.

You retain ownership of the content you input into Mentawe. By using the Service, you grant us a limited, non-exclusive licence to process your content solely to provide the Service to you.

We will not use your personal situation descriptions to train AI models or share them with third parties except as described in our Privacy Policy.

The Mentawe name, logo, product design, and all original content on the Service are the intellectual property of the operator of Mentawe and may not be reproduced without our written permission.

Use entirely at your own risk. The Service is provided strictly on an “as is” and “as available” basis, without warranties or representations of any kind, whether express or implied, including (without limitation) any implied warranties of satisfactory quality, fitness for a particular purpose, accuracy, or non-infringement, all of which are excluded to the fullest extent permitted by law. You acknowledge that Mentawe's outputs are AI-generated, may be wrong, incomplete, or unsuitable, do not constitute professional advice of any kind, and that you rely on them, and use the Service, entirely at your own risk and discretion.

No liability whatsoever, to the maximum extent the law allows. To the fullest extent permitted by applicable law, Mentawe, its operator, and anyone involved in creating or operating the Service shall not be liable to you or any third party for any loss, damage, cost, or claim of any kind whatsoever — whether direct, indirect, incidental, special, consequential, punitive, or exemplary — arising out of or in any way connected with your use of, or inability to use, the Service, the outputs it generates, any decision or action you take (or fail to take) in reliance on it, any meeting you record, prepare for, or analyse, any disclosure of confidential or sensitive information, or any conduct of any third party. This exclusion applies regardless of the legal theory on which the claim is based (including negligence) and even if we have been advised of the possibility of such loss.

Liability cap. Where, despite the above, any liability cannot lawfully be excluded but can be limited, our total aggregate liability to you for all claims is limited to the lesser of (a) the total amount you paid us in the three (3) months immediately preceding the event giving rise to the claim, or (b) £50.

You indemnify us. You agree to indemnify and hold harmless Mentawe and its operator from and against any claims, liabilities, losses, and costs (including reasonable legal fees) arising from your use of the Service, your content, your recordings, or your breach of these terms.

Mandatory exceptions. Nothing in these terms excludes or limits liability that cannot be excluded or limited under English law — in particular, liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for breach of the statutory rights of consumers that cannot lawfully be waived. Where you deal as a consumer, your statutory rights under the Consumer Rights Act 2015 are not affected. To the extent any part of this section is held unenforceable, the remainder continues to apply.

You may delete your account at any time from the app settings. We may suspend or terminate your account if you breach these terms, fail to pay your subscription, or if we reasonably believe your use poses a risk to others.

On termination, your personal data will be deleted in accordance with our Privacy Policy.

These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales, except that if you are a consumer, you may also have rights in your local courts.

We may update these terms from time to time. We will notify you of material changes by email or in-app notice at least 14 days before they take effect. Continued use after that date constitutes acceptance.
